Comments to FTC on Enforcement Policy Statement Regarding Personalized Pricing
The Lexington Institute has submitted comments to the Federal Trade Commission docket regarding the proposed Enforcement Policy Statement Regarding Personalized Pricing.
It makes a plain English case that the policy statement is vague, at best premature, likely to do more harm than good — especially with respect to discounts, and will be prone to abuse and overreach by future administrations. It also discusses the legal limitations the FTC has under Section 5 to pursue this matter.
It urges the FTC to halt developing its enforcement policy and study personalized pricing in a more focused and systematic way.
